Hi, Danielle as discussed,
This is a baseless claim and a vindictive claim by the same person who tried to get me fired and arrested last year for loading a car with nothing to do with them in the street.
I can see in the reflection on one photo it’s the same woman who inspected the cars on the night and reported nothing when it was inspected, it was a black car and shows every mark, also to add further insult she was telling me "I got the order wrong" but she was incorrect, to cause some kind of problem with the delivery she also would not let the yard hand taxi me back in one of the cars back to my truck even though he was already doing this to speed up loading time, she stopped him halfway through and he advised me she stopped him, so I had to walk back to get the rest of the cars from the truck, that's when the yard hand told me about her trying to get me fired last year as well.
I have had problems with that female employee who is a manager and is making this claim, I don't know her name, but I know who she is at that location,
Her own staff member who is a yard hand commented on her attitude and the type of person she is.
This manager is trying to get me back due to an issue a different customer's car on the public road next to echo park last year, while I was waiting for that customer to arrive to collect his car and the car was running loud because of how it was tuned, while I unloaded the echo park cars, later on that same female manager got some white male worker to come out and threaten me with "calling the cops" if I drive it again, I told him "call the cops based on what?, I did less than 25 MPH, it just sounds loud it’s the super charger that makes all the noise" and "I only turned the car around to put it back on the truck again, also I’m insured and licensed to move it if it's been on my truck, and I'm meeting the customer here, he mentioned "I can’t do this here" , I further advised him this is a public road and you don’t have authority over a public road, or me, or this company or the unit its self, also you’re not my manager" he went on to say well the cops are coming you’re going to jail ,, I then said "what are you talking about the cops are coming , for what revving an engine",
I put his cop threat down to me being a black male and the risk that palaces on someone of color when certain individuals with malice call cops and fabricate the truth on minorities to potentially escalate a situation against them,
since then every time I've been to that echo park site (twice) 2 staff members on 2 separate occasions advised me "it was her the manager who called the cops on you that day and she also tried to get you fired" not knowing I own the company I work for , it sounds ridiculous I know, I said "really" to the yard guy, I was shocked she went to all that trouble but it goes to show how vindictive she is and still holds some kind of grudge a year later,
I'm a quite recognizable person because I'm 2.6 half-back with a strong English accent and university educated, I don't have a problem calling people out who patronize me when I know they are been under the table indirect proxy racists by using the "cop" threat to try to intimidate minorities when nothing illegal happened in the first place, then try to get you fired from your work, this is not the first time this happened and does not belong in any workplace corporate culture,
The light chip marks on the front window are from the aging of the car racking up 60000 miles yes they are a few tiny rocks that built up on the wiper arm plastics while it was transported but that always happens on open carriers over 1000s miles of open transport, I can't stop dust on the road they should pay for closed carrier services if they are going to split hairs and make things up, also they isn't proof on the BOL inspection at the time of delivery, they were multiple tiny chips all over the front bumper cover of that merc very small so small you can't document them all with a camera, it's not practicable they were also swirls in the paint from it been buffed to hard, it’s a 3-year-old car black car probably an ex-rental unit that has age-related marks on the car, the unit was rained on and was dusty at collection so you can't see every tiny mark when the car is already dirty.
There were more cars with damage in that load that I documented because I assumed someone might try to blame me for it at that location.
In one of the pictures is she trying to claim for oil stains on the roof that dripped down one of their own cars or something? or a tiny crumb of a rock on the hood.?
The tiny marks on the very front of the car and the windshield have accumulated over the years and miles, this woman manager is acting in malice,
So, this whole claim is totally personal and frivolous and fabricated by her not echo park the business itself,
This claim is been used as a way for that same person to get back at me personally because she failed to get me fired from my own company over the unloading debacle on a car that had nothing to do with them on a public road from over a year ago and she needs to wind that neck in off hers and get off her power-tripping pedestal.
She's trying to make a false claim against my company based on baseless claims and lies, as you can see in the pictures, to seek some kind of retribution.
if she tries this fake claim game, I will personally escalate this as harassment by proxy by her, I will not tolerate employees using the cover of damage and the company they work for to seek revenge against a minority-owned business who called out the prejudice behavior.

I have shared this email with our executives.
As far as the damage claim goes, we have denied liability as the BOL was signed for clean.
I have not received any complaints nor seen any discrepancies with the receiving location and their claims.
Please note the damage that were claimed by the client are classified as transportation damage.
Any and all damages not noted at the time of pickup then discovered and noted upon delivery, will always result in liability being presented against the carrier/driver.

Denied liability so what are you saying?
There was no visible damage to the hood of that car or the bumper as she claims, the marks are tiny on the bumper, she is splitting hairs, a red jeep was in front of that merc and would have taken a beating the same as the merc.
I have more pictures of the load, I take photos of the cars loaded on the truck,
I was thinking about how she has placed that small tiny rock on the edge of the hood just in the middle but they is no actual damage in the photo just a tiny blue rock on the hood, and those tiny marks on the bumper you can hardly see next to the merc badge they were not visible at pickup and are so small you can't see them past a layer of dust on the surface, they have cleaned the front of the car in that picture,
I drove that car out from the belly of the trailer in reverse, it had to come out at an angle, then over the trailer wheels, and off the back of the trailer at another angle, the car bounces around while it's driven off a transporter, I reversed it down the road did a 180 degrees turn at the junction, so it was pointing the right way towards the echo park building, then drove further down the road and did a sharp left into the forecourt this was all done in a tight area about 120 feet, so they were a lot of maneuvering of the car, I doubt that rock in the picture was still balanced on the edge of the hood like in the photo, the same goes for the rock on the wiper blade after all that moving around, like I said that same woman is hellbent in doing me wrong, I don’t need this type of spectacle when I’m running my business, why would echo park staff tell me it was her who called the cops from over 8 months ago when a bloke came out, also they said she tried to get me fired what is that about ?,
I know when I’m been discriminated against indirectly by someone, I worked in corporate IT for 17 years and was mostly the only back engineer in the company when it happens it's not a single event but comes from the same person indirectly over a period of time, it's wired but trust me it happens and it is difficult to explain and prove you have to be colored to understand what I’m on about.
why she did not say anything to me when I was there during the inspection after she accused me of messing the order up because 2 of the cars on that load were going to west Sahara in Vegas, I did take them off so I could get the other cars off and she automatically thought a gray Prius and another car was hers,
the rocks were not where they were in the photos when I drove that car, and the hood was not damaged at all like I said 70 % of those units had small scuffs and scratches on some were more visible than others on bright cars so were documented others we not because it’s not practical I would be there all day on a used car, something shady is going on with that manager and it needs to be brought to their HRs attention.
The grit may have accumulated in the valance where the wipers park but I did not see that until the photos, which happens more in winter, I think she picked those rocks out of the valance when I was not there and placed them on the hood and wiper and took pictures of them the next day and the oil marks on the roof to try to make it look worse, and made a bogus fabricated claim for every mark and scratch and chip on 3-year-old hire car and claim it was caused by me these rocks to the point the whole front of the car needs to or replaced and painted knowing it would affect me financially.
it's absolutely ridiculous.

Hi Richard.
It is unnecessary to discuss this claim any further at this time. The liability for the loss was denied due to the customer signing your BOL clean at the time of delivery. Once the BOL is signed for cleaning, no damage can be claimed.

So Acertus are not demanding payment anymore, if that’s the case then thanks for taking this into consideration that was also my argument regarding the drop off inspection. I thought you meant "clean" at pickup, I'm still annoyed at what has happened there I'm seriously considering black listing that dealer ship, I feel this was not about anything other what was mentioned, but then again why should my company lose out on potential revenue because of one individual there, I've moved a lot of units to that location since it was built because I live in that area, it's a good back home route out of Texas, I haven't had any damages or issues with any other echo park , now we know what to expect at that site we will be taking extra precautions to ensure all damages even the smallest tiny ones are notated to make sure claims like this are dead in the water before they start.
We work to a high standard with every car that's shipped.
When we do make a mistake, we put it right but will fight bogus claims made for any reason other than ones made in a professional genuine nature.
Sorry for the harsh words but the full context of the situation had to be brought to your attention and I will not pursue this any further.

Today I sent in my new insurance details to compliance for renewal and updated my RMIS with a new policy document,
I was advised by an Aecrtus representative my account is still suspended with a note "not to use again" because of the event on March 14th, 2023 that included a complaint of discrimination regarding a member of staff at Echo Park Las Vegas where one staff member had been targeting me and my business on multiple different occasions, the behavior by the member of staff contained indirect discriminatory behavior traits towards a minority business owner.
I would like to understand why my account with Aceutus is still suspended because of this complaint, when 7992537 DAMAGE NOTIFICATION VIN WDD3G4FB7KW018459 claim was resolved via email by yourself,
it was agreed by Acertus, Royal Crown Towing LLC was not at fault for the false damage claim by that individual,
In an email, you mentioned, "The BOL was clean" .
By logging my complaint with the broker, I was exercising my right to make a formal complaint of discrimination in the workplace from a staff member at a private 3rd party business who I never actually met face to face, without fear of retaliation from the broker as a result of the complaint.
Royal Crown Towing LLC hasn't received any formal communication from Acertus regarding account suspension, any owned money from jobs that were withheld were paid to Royal Crown Towing LLC as a result of 7992537 being resolved,

I would appreciate you contacting me to discuss the details behind Royal Crown Towing LLC account suspension in more detail.
I can't see anything Royal Crown Towing LLC did wrong that breached the terms of the contract other than defend its rights to protect its employees of Royal Crown Towing LLC or the business itself from been targeted and discriminated against while conducting its business,
I feel unjust adverse action has been taken against Royal Crown Towing LLC because it engaged in a protected activity involving a complaint about discrimination.
It's why I made the complaint via the broker and not the dealer's location or their HR department, so not to escalate the matter past the broker, I felt it was important to highlight the background of the origin of that claim at the time is it was 1000s of dollars.
We have moved 100s of cars for many dealers all over the US for this brokerage and many others since 2020 without incident, with the exception of one white Audi Q5 back in Jan 2020 but that damage was paid in full and contained fake claims tagged on by the dealer 8 months after the delivery date had passed, that we did not agree with, and apart from a few damage payment date mishaps due to that Q5 claim nothing else major has happened and all debts have been settled and units delivered.

They arranged a conference call with their compliance team then they all dipped out and suspended my account.
I can still log in, but they are a do not use note on the system.
they basically used a damage claim that was paid over a year ago as the excuse and did not provide any proof of the 5 damage claims they stated below, one car that was damaged over a year ago an Audi Q5 and the claim had a whole raft of extras tagged on totaling 16 k 8 months later that I contested also all the damage was paid in full out of over 100s of cars moved in 3 years
here was the whitewash email from there compliance manager who was coached by Daniel as she changed her tone via email compared to on the phone.

Can you show me the evidence of those 5 claims please like you said you would?
I have been shown no proof of this, I would like the dates times and vins and where the units were damaged,
I recall only one damage claim on the white Q5 in Jan 2021 and the last one at echo park was proven bogus made by the same person who called the cops on me last year for been a black male doing his job on a public road.
Also, we were supposed to have a 3-way dialogue via conference call about my claims and the damage claims and called to confirm I feel you were genuinely concerned to have dialogue on the matter.
but now it's been decided to send an email so Daniele and the other manager don't incriminate there selves and their actions in front of me , this again proves my doubt about the ethics of Daniele and the management who looked at this at this company and it how the whole thing reeks of under the table retaliation because of a complaint about discrimination against a minority provider who made a comment about discrimination from one of your customers employees and was using fake damage claims to attack me indirectly.
it's more than likely the reason Acertus have decided to have that meeting behind closed doors and not included myself, because they know I will pull the entire smoke screen of damage allegations apart, let's not pretend we don't know the real reason why Acertus have decided to cancel my contact , it's retaliation because I made discrimination complaint about a member of staff at echo park, and using damage from 3 years ago on 5 units that I've haven't even been notified about is totally bogus this is been used to "whitewash" my complaint on a corporate level unfortunately.
Unless you can provide the evidence to back your claims that I've damaged 5 units, which I now have in writing from yourself and also proof in writing that all damage claims on one unit were paid in full or were not actual legitimate claims with zero evidence and were just corrupt dealers trying it on or have been made to justify my contact termination, I will be seeking legal counsel and taking this to the federal EEOC to see if any civil rights or labor laws have been broken.
I will also be contacting Echo Park HR regarding the behavior of their staff to wards minority independent contractors who weren't breaking any laws and why the feel is acceptable behavior to call the police on black people who haven't committed any crimes, is disgusting behavior,
And will reach out to the new CEO of Acertus on his linked in profile and other social media platforms to let him know what's going on in his company.
I have nothing else to say other than I'm discussed the outcome but also not surprised from a company that’s one of if not the most loathed by carriers in the industry and you have that reputation for a reason.
