Vehicle received with major damage

I shipped a 2003 Mitsubishi Eclipse on March the 30th with DAS. The vehicle was in route when I received a call saying there was minor damage. They said the care rolled forward because the emergency brake did not hold and there was a small dent in the fender. Also, they were moving it to a closed trailer because the door would not close.

When I received he car, the door had been dent backwards almost 90 degrees. There was absolutely no way the door was caught on the trailer. It was damaged because they were hot-dogging the car and the door flew open and over extended. There is no way the door could be damaged by rolling forward. Lie number 1.

They said once I get it to the dealership and evaluate the parking brake they would take care of the repairs. The dealer confirmed upon receipt that the brake was functioning correctly and held in both directions. They said they would take care of the cost given this information. Lie number 2.

The estimate came up to around 4k for repairs. They said they would send the insurance authorization right over. Lie number 3. A week later their adjuster shows up and tried to downgrade to care to next to nothing, so they don’t have to pay to fix it. They offered 2K for repairs and they body shop will have to negotiate with them for the difference.

Three weeks and they have yet to fix my vehicle. I was forced to pay for the repairs and take them to small claim court to pay for the damages. There is no way I will ever let this unprofessional organization move my outhouse. They wrecked my car and refused to repair it back to the original state. We are not talking a scratch or ding; we are talking the entire right side has to be replaced. They delayed and half stepped all along the way until they had to face the judge.
