This is a clear case of driver negligence. We as brokers (3rd party) are not liable for any damages made by the carrier. the driver in question was insured and when the customer tried to file a claim, under a technicality it did not fall under the damages that were made. As we tell all our customers. The drivers we use do carry insurance but it is also recommended to purchase extra insurance through their own insurance carrier for situations like this. As it does incur extra cost to the customer, most go away with it. Keep in mind Ebidtransport made every effort possible for this customer to recoup funds for the damages and is still in the process of doing so.
