Ms. Lee's order was subcontracted to Quick Tow, Inc. in Maryland and delivered to her location in San Francisco, California. Ms. Lee contacted our office regarding a damage claim on 1/23/07 and notification of the claim was transmitted to Quick Tow on 1/24/07. It was explained to Ms. Lee, at the time she filed her claim, that mechanical malfunctions are excluded under the Terms & Conditions supplied to her at the time she placed her order, and that such exclusions are the same for every carrier. Nevertheless, our Claims Department instituted an investigation into the matter to ascertain if the damage was a result of negligence by the carrier. A review of the Ms. Lee's account indicates that our Claims Department addressed issues related to her claim on twenty-three occasions, and reimbursed her for vehicle rental fees totaling $244.39 incurred as a result of the inoperable condition of her vehicle. Additionally, the claim was referred to Network Adjustors in Denver, Colorado who dispatched an adjustor to San Francisco to inspect the damage. As a result of the inspection, the claim was denied based on the "rust and corrosion" condition of the part involved.
