I was contacted by MoveAuto.net (a.k.a. FloField Inc.) after soliciting bids to move my 1989 Ford Bronco frmo Evansville, IN to Bloomfield, NJ. The email I received stated a "truck was in my area" and to "act now" showing a quote of $375. I contacted the company and spoke with Andy and we worked out the details. I received a final price of $413 to which I replied via email that this was acceptable and we should go ahead. I gave the $200 down payment and awaited the driver. I had informed Andy that I would be leaving on 28DEC2009. However I didn't worry much since "a truck was in my area" and my contract stated that 28DEC2009 was the first available pickup.
On 28DEC2009 I waited...and waited...and waited for the truck. I called Andy several times asking what hat happened and I was told the driver was "late". He advised me to leave the keys with the Property Manager, which I did. I called every few days to inquire as to my status and was continually told that it wasn't picked up yet. Finally on 12JAN2010 Andy informed me my car was picked up. I would like to mention this was 15 calendar days after my first available date and 10 business days from the first available pickup date. Their contract states they have one to ten days (does not specify calendar or business) to pick up the vehicle otherwise there is no further payment and the deposit is refunded (Section 6.1). I advised Andy of this and after some discussion simply said "Bring me my truck".
On 15JAN2010 my truck was finally delivered. I spoke to a representative at Dependable Auto Shippers to arrange payment and was informed I owed $537 bringing my total to $750. I called up Andy to inquire as to the descrepency and was informed it was a "gas surcharge". According to Section 6.7A this will not exceed 10% of the price or in my case $41.30. When I inquired as to what the rest of the overcharge could be for I was told the truck was too heavy and it was the "bigger Bronco". I reminded him I told him eactly what kind of car it was. He then explained that they couldn't find a driver over the holidays. I reminded him of the email that said a truck was "in my area". He then began whining that Dependable Auto Shippers raised their price to MoveAuto/FloField and he had to make money and what was he supposed to do. I informed him we had a contract that I expected him to honor. He offered me a $500 gas coupon (the original deal was $250). I told him that wasn't good enough. He then offered me a $50 check. I accepted but in reality had no choice but to pay the extra money, otherwise I'd have no car.
On 15JAN2010 I had contacted the Better Business Bureau and filed a complaint. I was suprised (but not terribly surprised) to find that this company that boasted "No BBB Complaints" had over 20 in the past 36 months. As of 25FEB2010 I had no received my coupon or refund. A few days later I received it and the fun continues. The gas coupon is not a gas coupon...it's a obstacle course. First you must spend $100 in one month for gas (I don't). After that you can register the "coupon" and receive a $20 voucher every month. After your next $100 you repeat the process. In short you'll receive your $500...over the next TWO YEARS! I also received the $50 check but was instructed not to cash it since Dependable Auto Service would be crediting my account for the $50. As of 24MAR2010 this has not happened.
So let's recap the situation, false advertising (No BBB Complaints), fraudulent pricing, breach of contract, deceptive sales practices, and substandard customer service. How do I know they have failed in these issues because (to coin their customer service department a.k.a Andy's phrase) I *READ READ READ*!!!! ANY company who puts in their contract that you should not dispute the charges with your credit card company but with them should be suspect.
Also since I READ READ READ I have found out that though their address is in Connecticut any legal action must be taken in NY. As their address is Jericho, NY that is Nassau County. For any who are interested here is the link on how to start Small Claims Court proceedings:
Good luck and again I strongly advise do not do business with this company.
Now I'm curious how they will respond. Am I not a customer? No, Andy, I am - I left my name out there for all to see. Did I "READ READ READ"? Well since I qouted which sections of the contract you breached I think I did. What other excuse(s) do you have?
