Didn't deliver but kept deposit

I needed a van picked up on a very tight time schedule. They would have just over 2 1/2 days to schedule a driver, and 5 days to pick it up. They were told this in advance. They told me they could not only meet that schedule, but they could also get it picked up within the 2 1/2 day time frame. When the allowable time to have it scheduled for pickup expired, they still didn't have a driver nevermind have it picked up as promised. But they kept my deposit anyway. The manager that called me about the deposit said it didn't matter what the salesman said or promised, and didn't matter that they failed to deliver what they promised to deliver. Once they have the doposit, they don't give it back, period. The manager said that I should have modified the fine print of their contract to add a stipulation making it null and void if they didn't fulfill their end of it, and since I didn't, the deposit was theirs. On the plus side, I found the salesman (David Peery) very knowledgeable and very helpful. I wonderful guy to work with. Summary, if you're fluent in legalese and comfortable changing the fine print of their contract, or willing to pay your deposit without them delivering your auto, then they are probably a good company to work with.
