I work for an independent BMW service and sales facility. We subscribe to an internet dispatch service that matches loads to carriers. Indiana Transport of Elkhart Indiana accepted our bid of $300 cash on delivery to move a 1998 BMW 540i with a blown engine from Rochester, Minnesota to Detroit, Michigan. When the vehicle was delivered, we paid the driver, DeWayne Herschberger $300: I only had $240 in my pocket and had to borrow $60 from one of our mechanics. The mechanic followed me up to the office and watched me count out the $300 to the driver. The driver gave me a receipt showing $300 paid and the paperwork for the bill of lading.

The following day, the customer called from Minnesota, we told him we would add the cost of the tow to his service bill. The customer said what the heck- he paid the driver, same DeWayne Herschberger $300 cash when he picked the car up and he had a receipt. We immediately called the driver on his mobile phone on conference and the driver said call the office. I called the office on multiple occasions and the office said the spoke with the driver and he says we did not pay him $300 when he dropped the car off. Joe Bonacorsi, an owner of Indiana Transport says DeWayne has worked for him for approximately 1 year and has no reason to doubt he is telling the truth- that it is "he says, she says." Well, Indiana Transport, it is NOT he says, she says, it is he says THEY say, my mechanic was standing there and watched the money change hands.

I explained to Joe Bonacorsi that I filed a police report, this is now a criminal matter on the part of DeWayne Herschberger and will file a small claims suit against Indiana Trucking to recover our $300. As of yet, Indiana Transport is taking the side of their driver saying that we have no proof that their driver accepted $300 at the time of delivery- I faxed Joe a copy of the receipt and it was the same receipt that the driver gave to our customer in MN when he was paid at pick-up of the vehicle.

DO NOT USE INDIANA TRANSPORT! Dishonesty has no place in this world!
