This car referred below it was supposed to be delivered on
10/20/2013.
The problem began because when the carrier was there to pick up the car, customer related in the contract that car was running but the car was not running, so carrier sent this email to me, in the next day:

We were delayed due to Daniels vehicle not running. Scott had told us he made Daniel fully aware that the vehicle he purchased DID NOT RUN. The driver had been calling Daniel since he left IL yesterday, and he refused to answer the phone until 11:00 P.M when he gave us his brothers phone number for delivery. Daniel was made aware that the driver did not have a receipt since this was paid through the office, and we offered to fax or email Monday A.M. The driver then called Daniels brother to deliver, and was advised that he didn't have any money to pay for the towing charge. I called Daniel to advise him of the consequences if he did not show up to pay for the transport. Daniel then refused to answer the phone. I had the driver wait for 30 minutes with NO contact from Daniel, and returned him to the Cleveland Ohio area. Below is the breakdown of what Daniel owes in cash for his vehicle to be released to him. A copy of the towing receipt will be included with Daniels transport receipt upon pickup. PLEASE PASS THIS ON TO DANIEL - In the state of Ohio if you do NOT claim your vehicle within 15 days the state allows us to file title for ownership on such said vehicle. Please call with any questions.


Charges-

- Original transport fee from IL to OH $350.00
- Towing charge to load INOP $65.00
- Additional 1 hr wait time at Ford $20.00
- Transport Columbus to Medina $200.00
- Daily storage @ 20.00 $20.00 - Sunday through ??

If arrangements are made to be picked up before 5:00 P.M 10-20-13 the total is $655.00. We will NOT be transporting this vehicle back to Columbus. Daniel will have to make his own arrangements from our impound.

THE CARRIER REFUSED TO DELIVER THE CAR - CUSTOMER HAS TO GO TO HIS PLACE 4 HOURS AWAY AND PAY WHAT THE DRIVER WANTS TO HAVE THE CAR BACK. Nobody is obligued to refund of a service if the person doesn’t show up the receipt to be refunded.

I WAS CALLED BY THE TRACK DRIVER WHEN HE REACH MANGOLD FORD TO PICK UP MY 2004 LANCER. HE SAID THE CAR CAN NOT START SO HE IS CALLING A TOWING TRUCK TO LOAD HIM AND I WILL PAY FOR THE COST WHICH I AGREE TO THAT. I TOLD HIM TO CALL ME TO TALK TO THE TOWING DRIVE ABOUT THE PRICE WHEN THE TOWING TRUCK GET THERE WHICH HE DID NOT CALL ME. I LATER RECEIVE A CALL AROUND 11PM FROM THIS TRUCK DRIVER TELLING ME HE IS ALREADY IN COLUMBUS TO DELIVER THE CAR AT THAT LATE HOUR. THEN HE TOLD ME THAT THE TOWING DRIVER HE CALLED TO LOAD THE CAR CHARGE HIM $85 DOLLARS FOR LOADING JUST ONE CAR WHICH I HAVE BEEN PAYING $25 FOR THAT SAME SERVICE. I SAID TO HIM I WILL PAY YOU $350 FOR THE TRUCKING,ABOUT THE $85 I WILL NEED A RECEIPT WHICH THE TOWING DRIVE GAVE HIM TO PAY FOR THE $85 WHICH HE HAS REFUSED TO GIVE ME THAT RECEIPT TO TAKE THE $85. Dear Diego Armando Fernandez, Lea Lerario, We have received your complaint concerning an issue you are having with Pinnacle Towing & Transport . Please review the terms of your contract and contact all parties to discuss any issues that may be preventing the timely delivery of this vehicle. The contracted shipper is the only one authorized to renegotiate the terms in the original contract in writing once an agreement is reached between parties.

Here are some disputes commonly impeding delivery:

COD not available: Collect on Delivery contracts must be compensated as such.
If for some reason personnel are unavailable to “hand” the pay to the carrier on delivery, it must be compensated the same and available for immediate access after the delivery.

Delivery with Damages: A damage issue and transport fees are viewed as two separate issues. A carrier must be paid according to the terms in the contract.

Late delivery: A carrier must be paid according to the terms in the contract.
If compensation for late delivery is requested by the customer, it is at the carriers’ discretion to honor as a customer service or not.

Additional Services performed: Sometimes additional services are identified or required after pick up. Once a vehicle is in the possession of the carrier, if a written contract exits, unless renegotiated in writing, the original contract remains in place. However, if a carrier is able to present written confirmation of additional services, or if they are not disputed they should be compensated accordingly. Additional services may include (but are not limited to): inoperable vehicle when dispatched as operable, tow fees, redelivery when customer was unavailable, personal possessions, load and storage fees.

Although the best scenario would be that this issue could be worked out between you, CentralDispatch will be in the process of also attempting contact with this transporter on your behalf. Once contact is made, our office will then request that the carrier company contact your company as well as the customer with an update on the delivery status of the load. While we are assisting you, do continue with your present efforts to resolve this issue with the parties involved.

THERE WAS NO CHANGING IN THE CONTRACT NEITHER ANY AMMENDMENT SAYING RE CARRIER ONLY DELIVERS THE CAR AFTER CUSTOMERS PAYS THE TOWING – INDEED CUSTOMER ALWAYS SAYS HE WANTED TO PAY – EVEN MORE BUT HE WANTED CARRIER TO DELIVER THE CAR THE PLACE WAS IN THE CONTRACT AND THE CARRIER DENIED – CARRIER WANTED CUSTOMER GO THERE TO PAY STORAGE FEES, MORE TOWING – TO GIVE HIM A COPY OF THE TOWING RECEIPT – THIS IS NOT POSSIBLE TO REFUND IF THE THIRD PARTY DIDN’T GIVE YOU A RECEIPT. BUT THIS INDEED DIDN’T WORK, BECAUSE CUSTOMER GOT A RECEIPT WITH THE TOWING COMPANY. CARRIER DIDN’T OBEY THE CONTRACT AND CUSTOMER IS WILLING TO PAY –CUSTOMER IS NOT REFUSING TO PAY .



UNTIL NOW:

CARRIER NEVER DELIVERS THE CAR UNTIL TODAY, AT THIS MOMENT CUSTOMER IS THERE AT THE FRONT OF CARRIER'S PLACE TRYING TO PAY AND RECOVER THE CAR.
NEVER SHOWS THE RECEIPT
CUSTOMER HAS A COPY BECAUSE TOWING COMPANY SENT TO HIM
CARRIER NEVER DELIVER THE CAR AS STATED AS IN THE CONTRACT
