Dear Josh Johnson,
we are really sorry for the situation that occurred between you and our company.
You signed the contract with us and we've done everything according to it: scheduled a driver for you, agreed on all the terms via the phone and email, sent you all the driver's contact details to your email address.
But when the driver came to pick up your car the vehicle was not ready.
The driver and us were trying to reach you but couldn't get a hold of you. Then we contacted the delivery contact and that person told us the car was not ready to be picked up.The driver had no choice but to cancel the shipping.
As an exception we gave back to you our commission in amount of $80.
But according to item 10 of our contract which says :
10. It is Client's responsibility to ensure that vehicle(s) is(are) ready to be released to the chosen Carrier by the projected pickup date provided by Client at the time of order placement. Failure to release vehicle(s) to scheduled carrier for any reason (including but not limited to: storage, auction, port, towing, mechanical, purchase fees, scheduling or personal issues, etc.) may result in cancelation and/or a 'Dry Run' fee . Standard fee for 'Dry-Run' is One Hundred Fifty Dollars ($150.00). Client may elect to reschedule a new Carrier through TMSHIPPING (additional fees apply). All deposits are final and non-refundable.
That's why we had no choice but to charge $150 from your CC as a cancellation fee. We have to send these money to the driver as a Dry Run fee.
Again, we appologize for this situation.
And we will ship your car for free the next time you decide to use our services.
